GENERAL CONDITIONS

1. Rental agreement.

The contract is concluded between us, the vehicle provider, and you, the primary driver, as designated on the rental agreement.Please read the General Rental Conditions and the Specific Conditions of the rental location, which form an integral part of your rental

2. -The Vehicle.

We must provide the vehicle and all mandatory safety equipment (hereinafter referred to as the 'vehicle') in good working condition, duly registered, and with all related taxes paid. In Morocco, we must provide vehicles that are compulsorily insured for third-party liability. As such, the driver is not considered a third party and is therefore not covered by this insurance. You must return the vehicle and optional services/products in the condition in which they were provided to you, except for normal wear and tear. Please inspect the vehicle thoroughly before your departure.

Please ask us to rectify the vehicle condition report if any damage is not indicated, in case of an error in the fuel level, in the absence of a license plate, insurance certificate, accident report form, or any other mandatory safety equipment in the vehicle.

3. Rental Period.

You are responsible for the vehicle and optional services/products for the entire rental period: The rental period starts from the moment you take possession of the vehicle ('pick-up procedure') and ends upon our confirmation of the return of the vehicle and its keys ('return procedure').

You must return the vehicle to a return agent during the opening hours at the agreed return agency. If you choose to return the vehicle outside of opening hours or if you leave before the end of the vehicle return procedure, you do so at your own risk and remain responsible until the end of the return procedure.

If you use the 'Delivery and Pick-up' service, you will be responsible for the vehicle from the moment it is handed over to you until we collect it.

4. Cost.

You must pay the amounts indicated on your rental agreement for the vehicle and any optional services subscribed to for the rental period. You are liable for the payment of any extension of the rental period, including any optional services subscribed to. You are liable for the payment of costs related to theft and damages, deep cleaning fees, towing fees, toll fees, and fines related to parking, traffic, or use of the vehicle, as well as administrative management fees and processing fees, as provided in these conditions.

5. Use of the Vehicle:

You must:

i) Use the vehicle prudently and diligently.

ii) Use the vehicle in compliance with the laws and regulations of the country in which you drive.

iii) Use the vehicle lawfully and for legal purposes.

iv) Use the appropriate fuel.

v) Lock the vehicle when not in use and ensure that all windows, sunroofs, panels, or removable roof tops are properly closed.

vi) Stop using the vehicle immediately, provided that your safety is preserved, and inform us immediately in case of a defect in the vehicle.

You must not:

i) Use the vehicle for commercial purposes; for any motor sport (whether for leisure or professional purposes) or related activity; off-road; to tow another vehicle or trailer; to transport flammable, explosive, corrosive, or oxidizing materials, except for the fuel required for the vehicle's operation.

ii) Allow anyone other than an authorized driver to use the vehicle.

6. Accidents, Theft, and Damage

You must notify

i) the police immediately

ii) our company within 48 hours if the vehicle is involved in any accident or damage, even if no third party is involved.

If the vehicle is lost, stolen, or damaged, you must, to the extent permitted by law, pay the deductible amount indicated in this rental agreement, all applicable taxes, and our damage or theft processing fees (unless you have subscribed to additional protections to further reduce your deductible). Your deductible will not apply in the circumstances defined in Article 7 concerning Additional Protections.

We will attempt to recover the deductible and other fees from the at-fault party if you can demonstrate that the damage, theft, or loss was not due to your fault, deliberate violation, fraud, or gross negligence (within the limits of applicable legal provisions). You must provide us with a duly completed accident report form including the contact details of other parties involved within 48 hours of the accident. To the extent permitted by law, we will apply fees covering our costs to contact you to obtain a duly completed accident report. You will not be held liable for loss or damage due to our failure to maintain the vehicle or covered by the manufacturer’s warranty.

7. Additional Protections

Additional protections reduce the amount you have to pay up to the deductible amount indicated in case of theft or damage to the vehicle. Our rates include a basic deductible, and we will not charge you more than the indicated deductible, any applicable taxes, and our damage or theft processing fees (except in cases where your deductible is inapplicable). You can further reduce your deductible by subscribing to other additional protections.

Your deductibles are inapplicable (in which case the amount to be charged is no longer limited) if the loss or damage is due to

i) a deliberate or fraudulent act, omission, or gross negligence on your part (within the limits of mandatory applicable legal provisions), or

ii) a deliberate violation of the stipulations in Articles 5 (Use of the Vehicle) and 6 (Accidents, Theft, and Damage). If your deductible does not apply, we will be entitled to claim compensation, the amount of which will take into account the severity of the negligence and may be equal to the amount of our loss, for the damage suffered or to come (whichever is higher), within the limits permitted by applicable law.

Subscribing to the PAI (Personal Accident Insurance) additional protection covers you for bodily injury and death resulting from a traffic accident during the rental of the vehicle. According to the applicable legislation, the maximum compensation in case of death is Twenty Thousand Dirhams (MAD 20,000). In case of subscription to the Super Personal Accident Insurance (Super PAI), the maximum compensation in case of death is Forty Thousand Dirhams (MAD 40,000).

8. Fines and Fees

You agree to pay parking fees or traffic fines incurred during the rental period and resulting from your use of the vehicle. You agree to pay our management fees, covering our time spent processing these fines or fees unless you can demonstrate the absence of loss or damage or, if applicable, that the amount of damage suffered is significantly lower than the processing fee.

9. Fuel

You must return the vehicle with a full tank of fuel. If you fail to return the vehicle with a full tank, you must pay for the consumed fuel according to our current rates.

10. Additional Drivers and Passengers

You must ensure that any additional drivers you add to the rental agreement or passengers you allow in the vehicle comply with these conditions. You are responsible for the costs and/or fees incurred due to non-compliance with these conditions by any additional driver or passenger.

Your deductible is inapplicable if the loss or damage is due to a deliberate or fraudulent act, omission, or gross negligence by an additional driver or passenger (within the limits of mandatory applicable legal provisions) or a deliberate violation of the stipulations in Articles 5 and 6.

11. Changes to Your Rental

You must bear any price increases if you modify the rental period. You will have to pay a one-way fee if you return the vehicle to a different agency than the one from which it was picked up.

12. Early Return

If you return the vehicle and all optional services early, you will lose the benefit of any special offers if you no longer meet the corresponding conditions. This could result in you paying a higher amount for the rental. No refunds will be given for unused rental days.

13. Late Return

Unless otherwise agreed, you must return the vehicle and all optional services at the time/date and place specified in the rental agreement. If you think you will be late, it is in your interest to request an extension. If you are late, you must pay for an additional rental day.

14. Pre-Authorization (Payment)

We will request a pre-authorization from your bank for a debit on your payment card. This procedure reserves a certain amount on your payment card to ensure the availability of sufficient funds. We will only proceed with the payment at the end of the rental. Note that if you make the payment with another card, it may take up to 30 days for your bank to release the funds 'reserved' on your other card.

15. Payment

By signing the rental agreement, you authorize us to debit all charges incurred during the rental period from your payment card.

16. Monitoring

Vehicles may be equipped with geolocation systems and tracking devices to locate them in case of theft or non-return to the rental agency, or to locate the vehicle in case of an accident or breakdown.

17. Use of Your Personal Data

We use your personal data to:

a) Provide you with rental services.

b) Decide whether to provide you with rental services in the future. We only share your personal data as permitted by law and, if necessary, with your express consent, with the following:

c) Members of the Spingo Rent Car system.

d) Authorities and parking management companies, within the limits of applicable legal provisions, to verify the validity of your driver’s license.

e) Third parties acting on our behalf in the processing of claims, recovery of amounts you owe us, and conducting customer surveys, which we use to improve the services we offer.

You have the right to access the personal data we hold about you (subject to the payment of related fees, within the limits permitted by applicable law) and, with justification, you may request that any personal data concerning you be corrected, modified, blocked, or deleted. The data controller is the vehicle rental provider, as designated in this rental agreement.

18. Loss of Property

We will do our best to contact you if we find any personal belongings left in the vehicle. Any items containing personal or financial information will be deleted within 28 days, in accordance with our privacy policies and the stipulations of the General Terms and Conditions of Rental. All other items will be deleted within three months.

19. Applicable Law

The law applicable to this contract is the law of the country where the vehicle is picked up and the rental contract is concluded.
